Gift Experience Terms & Conditions

1. Who we are and how to contact us

1.1. We are Uniquely Local Experiences Limited, a limited company registered in England and Wales under company number 13432837 and with registered office address at Office 22, Unit 15, Kettlestring Lane, York, YO30 4XF (“we”).

2. Vouchers

2.1. We issue gift and experience vouchers at https://uniquelylocal.co.uk/ (“Site”). You can use the experience vouchers purchased at the Site to book for the corresponding experiences which are provided by third parties. You can use the gift vouchers to choose any of the experience’s listed on the website.
2.2. All of our experience and gift vouchers are fully flexible and can be used for any of the experiences listed. Even if you choose a specific experience voucher for the recipient they have full flexibility to exchange it for an alternative experience voucher of the same value if they so wish. They may also upgrade their experience voucher by paying the difference or choose a less expensive experience and receive a credit gift voucher for the remaining amount. The validity period of the exchanged experience voucher or credit will be calculated from the purchase date of the originally purchased experience voucher. Please email us to facilitate an exchange.
2.3. The vouchers will be sent electronically or via post to the address indicated in your order. You shall ensure that the information you provide when you place the order is complete and accurate. We will not be liable if you cannot receive the voucher because the information you provided us is incorrect or incomplete.
2.4. Vouchers sent by post will be subject to the postage costs set out on the Site and we will not be liable for any problem with the voucher that is related to the post.
2.5. Vouchers sent electronically will be sent shortly after your order has been placed and you in accordance with clause 5 below. Vouchers sent via post are expected to be delivered within the timescales set out by the Royal Mail.
2.6. You must keep and must ensure that any person to whom the voucher is gifted keeps the voucher safe and secure. We will not be liable for vouchers that are lost or damaged after they are delivered. We shall have no obligation to replace the vouchers under these circumstances.

3. Experience Vouchers

3.1. The experience voucher will display:

• its unique voucher code
• the name of the holder of the experience voucher;
• a brief description of the experience to which the experience voucher relates (“Experience”);
• the validity period or expiry date of the experience voucher
• any restrictions that apply to the Experience;
• information about how to book the Experience and use your experience voucher with the third-party provider;

4. Gift Vouchers

4.1. The gift voucher will display:

• Its unique gift voucher code
• The name of the holder of the gift voucher;
• the amount in its denomination;
• the validity period or expiry date of the gift voucher;
• any restrictions that apply to the redemption of the gift voucher;
• instructions about its redemption;

5. Orders

5.1. The placing of an order constitutes your acceptance of the terms and conditions set out in this agreement but does not constitute the creation of a contract between us.
5.2. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the vouchers. This might be because (i) the experiences are no longer available, (ii) of unexpected limits on ability of the third parties to deliver the experiences, (iii) we have identified an error in the price or description of the vouchers or (iv) we are unable to meet a delivery deadline you have specified.
5.3.  We will confirm receipt of your order through our on-screen confirmation of your order. We will confirm acceptance of your order and receipt of your payment via email.
5.4.  If an order cannot be fulfilled for any reason, we will promptly refund you.
5.4. The Experiences to which the experience vouchers relate shall be booked directly with the third party that provides such Experience and will be subject to their terms and conditions.

6. Experiences

6.1. The experiences advertised at the Site are supplied and delivered by the third-party provider named on the Site and the experience voucher. We do not recommend or endorse any such third-party provider.
6.2. Any information available at the Site and/or in the experience vouchers about the experiences has been supplied by the third party that provides the experiences. We have not reviewed any such information and we are not liable for its accuracy or completeness.
6.3. The Experience and the use of the experience voucher will be subject to the terms and conditions of the third party that provides the Experience.
6.4. We shall not be liable for any problems you may have in connection with an Experience. In particular, we do not guarantee any of the following in relation to the Experiences:

• that the Experience will be available on the dates of your choice;
• that the Experience will be private and not open to the general public;
• that you will be able to reschedule the Experience due to weather conditions;
• that the Experiences will be delivered on time and to your satisfaction;
• that the third-party provider will not alter any aspect of the Experience;
• that the third-party provider will not cease to offer the Experience before the expiry of your experience voucher;
• that you will have the right to cancel an Experience after it is booked;
• that the Experience will be free of restrictions; or
• that spectators will be allowed during the Experience.

6.5. You shall check the details of the Experience on the Site and the terms and conditions of the third-party provider before you redeem a gift voucher or purchase an experience voucher for any experience advertised on the Site.
6.6. The experiences may vary from their description. In particular, they may not be identical to the photos shown at the Site. Such photos shall be considered for illustrative purposes only.

7. Returns, Refunds and Voucher Extensions

7.1. Subject to clause 7.3, you have 30 days from the date when you receive a voucher to change your mind and return the voucher. If you want to return a voucher within this 30-day period, you shall send your voucher to us along with a cancellation form explaining the reason for your request. You will not have the right to return a voucher after this 30-day period.
7.2. After you return the voucher to us, we will refund you the amounts you paid for the returned vouchers less any postage costs (if you selected to receive the voucher via post). The refunds will be processed within 30 days after the return of the voucher using the same payment method you used to purchase the voucher.
7.3. You will not have the right to return an experience voucher and receive a refund in accordance with clauses 7.1 and 7.2 if you book an Experience with the third party provider within the referred 30-day period. You shall not have the right to return a gift voucher and receive a refund in accordance with clauses 7.1 and 7.2 if you have redeemed the gift voucher within the referred 30-day period. You will not have the right to return a voucher if you won it as part of a competition prize or promotional free gifts we offer.
7.4. After you book an Experience, cancellations and refunds will be subject to the terms and conditions of the third-party that provides the Experience.
7.5. If you cannot redeem a gift voucher or if you cannot book the Experience using an experience voucher due to a problem in the voucher, we will also refund you. If this happens, you shall send your voucher to us along with a cancellation form explaining the reason for your request and we will process the refund in accordance with clause 7.2. Alternately, we can send you a new gift voucher for the same amount or a voucher for the same Experience.
7.6. Voucher extensions are granted at our discretion. An administration fee of £20 will be required to extend your voucher. If the activity has increased in price, you will also need to pay the difference in price and this is subject to product availability. Once a voucher has been extended it cannot be refunded. Please email us to enquire about a voucher extension.

8. Bookings

8.1. The experience vouchers can only be used by its holder and cannot be transferred or re-sold.
8.2. The Experience must be booked before the date when the experience voucher expires. After the experience voucher expires, you will not be able to purchase or book the Experience.
8.3. After you use the experience voucher to book the Experience, it will no longer be valid, and you will not be able to use it again.
8.4. You shall book the Experience directly with the third-party provider.
8.5. We encourage you to book the Experience as soon as possible after you purchase the experience voucher so that you have more chances to find availability for the date of your choice.
8.6. You should not make any travel or accommodation arrangements in connection with the Experience before you receive the confirmation from the third-party that provides the Experience.

9. Price, Payment and Credit Checks

9.1. The prices of the vouchers are set out at the Site.
9.2. You shall pay for the vouchers using one of the payment methods listed at the Site.
9.3. If you pay with PayPal, such payment will be subject to PayPal’s terms and conditions.

10. Competition Prizes, Special Offers and Discount Codes

10.1. We may run competition prizes and make special offers for the vouchers we sell on the Site. These prizes and offers will be subject to their own terms and conditions – which usually include restrictions on the validity of the voucher and/or the dates and times when you can book the Experience.
10.2. You must check the terms and conditions of the prizes before you join the competition and the terms and conditions of the special offer before you purchase a voucher under such offer.
10.3. We may also send you discount codes for the purchase of vouchers. You can use only a discount code per purchase and check the terms and conditions of these codes before you use them.

11. Our liability

11.1. If we fail to comply with these terms and conditions, we are responsible for losses or damages you suffer that are a foreseeable result of our fault, but we are not responsible for any loss or damage that is not foreseeable, or which relate to the third-parties that provides the experiences. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
11.2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for:
11.2.1. death or personal injury caused by our negligence;
11.2.2. fraud or fraudulent misrepresentation;
11.2.3. breach of your legal rights in relation to the vouchers;
11.2.4. defective vouchers under the applicable consumer legislation; and
11.2.5.Unless otherwise specified in this Agreement, our aggregate liability to you in connection with this Agreement shall not exceed the value of the Vouchers ordered by you or on your behalf.

12. Changes

12.1. We may change the vouchers we offer on the Site and/or these terms and conditions at any time. These changes will not affect orders you have placed before these changes are implemented.
12.2. Please note that the third-parties providers may change the experiences they provide at any time in accordance with their terms and conditions.

13. Data Protection

13.1. We will only use your personal information as set out in our Privacy Policy.

14. Other important terms

14.1. If a court finds part of these terms and conditions illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
14.2. These terms and conditions are governed by English law and you can bring legal proceedings in respect of the vouchers in the English courts. If you live in Scotland you can bring legal proceedings in respect of the vouchers in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the vouchers in either the Northern Irish or the English courts.

15.1. We welcome your feedback on all of experiences. If you are particularly pleased with an experience or if you have any problems with the third-party provider, please tell us.
